European Cinema congratulates the European Parliament for its vote in favour of Culure

Eurocinema, Europa Cinemas, Europa Distribution, Europa International, the European Producers Club, FERA, FIAD, SAA and UNIC congratulate the European Parliament for voting in favour of the resolution calling for the exclusion of cultural and audiovisual services, including online services, from the negotiating mandate of the free trade agreement between the US and the EU. This resolution was adopted with a large majority which demonstrates the strong support for the preservation of the cultural exception.

This vote is historic and we welcome its political impact. European cinema thanks the Members of the European Parliament for their understanding of the challenges at stake for culture and for their support to European filmmakers who expressed themselves in favour of such exclusion in a petition that has already been signed by nearly 5,500 professionals.

But we must keep going. Eurocinema, Europa Cinemas, Europa Distribution, Europa International, the European Producers Club, FERA, FIAD, SAA and UNIC now call on the European Commission to take into account this vote of the European citizens’ representatives and on the Member States to support the exclusion of cultural and audiovisual services by 14 June, when Member States will adopt the negotiating mandate to be given to the Commission.

Eurocinema, Europa Cinemas, Europa Distribution, Europa International, le Club des Producteurs Européens, la FERA, la FIAD, la SAA et l'UNIC  félicitent le Parlement européen pour son vote de la résolution exigeant l’exclusion explicite des services culturels et audiovisuels, y compris les services en ligne, du mandat de négociation de l’accord de libre-échange entre les Etats-Unis et l’Europe. Cette résolution a été adoptée à une très large majorité prouvant un mouvement fort en faveur de la préservation de l’exception culturelle.

Ce vote a une portée politique historique que nous tenons à saluer. Les organisations européennes du cinéma remercient les parlementaires européens d’avoir compris et soutenus les enjeux liés à la défense de l’exception culturelle et accompagné les cinéastes européens qui se sont exprimés pour l’exclusion dans une pétition signée par près de 5 500 professionels.

La mobilisation continue. Le Club des producteurs européens, Eurocinéma, Europa Cinémas, Europa Distribution, Europa International, la FERA, la FIAD, la SAA et l’UNIC appellent maintenant la Commission européenne à prendre en compte ce vote des représentants des citoyens européens et les Etats membres à soutenir l’exclusion des services culturels et audiovisuels d’ici le 14 juin, date d’adoption par les Etats membres du mandat de négociation qui sera donné à la Commission.

Fera President Alan Parker seeks meeting with EU President Barroso

As President of FERA, representing thousands of European film and television directors, British director Sir Alan Parker has written today [25.04.2013] to President Barroso seeking clear justification for the Commission’s refusal to insist on the cultural exception in the forthcoming trade negotiations.

In his letter, Sir Alan congratulates the Commission on the project for talks, which could bring long term economic gains, and thanks Commissioners de Grucht and Vassiliou for their reassurances, but is nevertheless asking for solid guarantees that the TTIP negotiating mandate will be strengthened by mid June. European systems of audiovisual support must not be traded away, now or inthe future, he argues, and future programmes such as Creative Europe must be absoutely free to develope despite any EU-US trade agreement.

Deploying widely accepted arguments on the 2005 UNESCOConvention on the Diversity of Cultural Expression, and the Lisbon Treaty, Sir Alan points out that, due to the Subsidiarity principle, it may in fact be illegal to for the Commission make concessions that might prejudice European cultural aid schemes.

His letter also draws attention to the economic importance of the cultural industries. ”Losing or weakening audiovisual support schemes as part of a trade deal would cause not only cultural but economic damage, and certain loss of employment,” he argues.

Sir Alan asks for a face to face meeting with the Commission President in the next few weeks to receive the cast iron assurances that European directors are seeking.

EU Film Directors voice concern over trade talks

FERA, the Federation of European Film Directors, welcomes EC Culture Commissioner Androulla Vassiliou’s stance on the framework for forthcoming EU-US trade talks , and in particular her assurances that “Trade liberalization will not weaken those policies and measures at EU level, or in the Member States, which safeguard and promote cultural diversity, notably in terms of film and television programming” (23/2/2013).

However, since the cultural exception is not, apparently, going to be applied in the talks, which is most regrettable, FERA calls on Trade Commissioner Karel de Gucht and Internal Market Commissioner Michel Barnier, to explicitly confirm the assurances offered by Commissioner Vassiliou.

Given the well known US hostility to European support schemes for film, FERA further asks the Commissioners to confirm now that their negotiating position will adhere to the 2005 UNESCO Convention on the Diversity of Cultural Expression, formally adopted by the EU, a legally binding international agreement that supports the right of Member States to exclude cultural goods and services from international trade agreements. 

We further ask the Commissioners to undertake, when negotiations start, to stand firmly by the Lisbon Treaty, which enshrines cultural diversity at the heart of all European cultural policy. As culture in the EU operates under the principle of Subsidiarity it would presumably not be legal to make concessions that prejudice cultural aid schemes in the audiovisual sector.

Uma vibrante indústria de cinema e audiovisual cria uma força cultural e económica conjunta. O cinema é um produto real, gerador de emprego e de desenvolvimento, estimulando uma mais valia, longa e duradoura, possibilitando a reflexão e a renovação das nossas sociedades. Trata-se de um meio de comunicação universal, que atravessa literalmente fronteiras, descrito pelo Presidente cessante da FERA, István Szabó (Mephisto, Sunshine) como ‘a linguagem do rosto humano’, oferecendo um significante narrativo ao nosso passado e ao nosso futuro.

Enquanto a Europa procura reconstruir a sua economia, os realizadores Europeus de 29 países reunidos em Copenhaga aperceberam-se de um sector sob ataque. Membros de alguns países comunicaram a sua apreensão, antecipando que no espaço de dois anos se perspectiva a total inexistência de produção nacional, consequência do fim dos apoios estatais a esta actividade. A FERA acredita que uma política de  cortes ao financiamento dos sectores criativos pelos governos nacionais é errada e de ‘vistas curtas’, já que muitos muitos países estão a assistir a um acréscimo na procura de filmes nas suas línguas nacionais pelas suas audiências locais. A diversidade cultural não é apenas um princípio crucial para a Europa: ela funciona.

Os novos media digitais oferecem estimulantes oportunidades para o crescimento e uma maior acessibilidade para novas audiências, especialmente entre os jovens, muitos deles ambicionando um futuro profissional no nosso sector. A FERA saúda a paixão de uma nova geração interessada nos nossos filmes, através das salas de cinema e da internet, e está convicta que todos juntos iremos defender, a arte e a produção cinematográfica Europeia. Num período em que a Europa de forma inteligente aposta na criatividade, no seu crescimento e na sua sustentabilidade,  é importante que os seus cidadãos tenham uma maior compreensão sobre a importância dos direitos de autor, como sendo a base da viabilidade das actividades culturais e de todas as indústrias criativas.

Os Realizadores Europeus apelam para:

- Todos os países Europeus reforçarem os seus apoios para o cinema através de legislação específica e de incentivos financeiros que permitam que os seus cineastas contribuam para a riqueza cultural e económica Europeia:

-  A Comissão Europeia, que tem o dever de “apoiar os aspectos culturais através de medidas específicas na sua acção conforme o determinado em diversos Tratados, especialmente através do respeito e promoção da diversidade das suas culturas” (Artigo 167 Tratado Operacional da União Europeia) actualmente no processo de revisão do diploma ‘Comunicação e Cinema’ sobre os apoios estatais ao cinema, alertamos que qualquer dano provocado no nosso sector, num momento tão crucial como o da sua transição para um media digital será muito difícil de reparar.

- A comunidade cultural Europeia, nas suas diversas áreas, mobilizar-se para lutar em conjunto pelo sector criativo.

- A FERA defende os direitos de autor, faz campanha pela protecção dos arquivos nacionais, pelo crescimento da produção cinematográfica e pelo encorajamento da distribuição nos diversos países da Europa dos filmes Europeus, quer nas salas de cinema quer através da internet.

Portugese Film Directors debate new Cinema Law
APR (Portuguese Association of Directors) held an extraordinary General Assembly on 11 February to discuss the draft of the new Cinema Law which was released on 1 February. APR welcomed the fact that the Secretary of State for Culture has fulfilled his promise to publish the bill for public consultation.
There are very positive proposals for the government to assume the responsibilities of film funding through programmes intended to provide economic support to various activities for the development of film art. The draft law proposes measures to broaden funding sources and set the level of financing rates and contributions to be paid by the various service providers, platforms and broadcasters.
Although some of the articles raise questions which will need to be addressed, APR generally approves of the proposed law.
However, as the law leaves some important definitions for later clarification, APR insists that they be defined in close collaboration with the professional associations.
Given the critical situation the Portugese film industry is currently in, the directors of APR appeal to the Prime Minister, the Secretary of State for Culture and Members of Parliament to approve this law and its regulation as soon as possible.!
This General Assembly was attended by FERA CEO Elisabeth O. Sjaastad, who expressed FERA’s concern about the situation facing our Portugese members, and especially the uncertainty surrounding the Institute for Cinema and Audiovisual (ICA) where the open calls for project funding have been suspended, with no clear information about when they will resume.!
In a statement released on 24 February on the subject of the new Cinema Law, APR poignantly draws attention to the recent international success of Portugese filmmakers:
“Portuguese films, which will be in increasingly small numbers from this year onwards, have captured the attention of film professionals from around the world. The awards that the filmmakers John Salaviza and Miguel Gomes received at this year’s Berlinale, is a great achievement for Portuguese cinema. They have proven their enormous vitality and ability to cross all borders. It is urgent to let them live!”

OS REALIZADORES EUROPEUS PROTESTAM CONTRA A DIMINUIÇÂO DOS FINANCIAMENTOS DOS FILMES

A Fédération Européenne des Réalisateurs de l'Audiovisual / Federation of European Film Directors (FERA, fundada em 1980 em Veneza) acaba de concluir a assembleia geral do seu 30º aniversário nos estúdios legendários de Cinecittá em Roma. Os realizadores europeus celebraram as 3 décadas de existência a debater o projecto da FERA para um contrato europeu de realizador, o Programa Média da União Europeia, a remuneração dos filmes na Internet, o acesso dos filmes europeus às salas preparadas para o cinema digital, e mais importante ainda nos dias de hoje, a dramática diminuição do financiamento dos filmes na União Europeia: na Itália, Hungria, República Checa, Irlanda, Portugal e Reino Unido.
A FERA compreende a necessidade de fazer economias neste período difícil mas a diminuição de incitamento fiscal à produção, a paragem na criação de infraestruturas, e a supressão de financiamentos para a produção e a distribuição vão pôr em perigo a própria existência do cinema europeu. Achamos estranho que por um lado a Comissão europeia tente “desbloquear potenciais industrias de criação”, e que por outro, os governos europeus utilizem a crise financeira para as roubar. Alguns ministros sacam do revolver mal ouvem a palavra cultura.
A cultura e o acesso á cultura são direitos humanos de base. A cultura define os países e os povos melhor do que as fronteiras. Isso é também verdade com o cinema europeu.
Mas esse cinema com todas as suas diferenças é também uma actividade económica fundamental. Em todo o mundo os investimentos no cinema e na produção para a televisão ajudaram a construir industrias, a alimentar novos médias, a criar empregos e por isso a contribuir para a economia do país. Cinema e audiovisual são indústrias do futuro, é preciso apoiá-las no tempo.
Fazemos um apelo a todos os governos europeus para que preservem as estruturas de apoio e invistam nos filmes e na cultura cinematográfica. Uma vez destruidas, não serão reconstruidas facilmente.

A F.E.R.A. representa actualmente cerca de 30 Associações de Realizadores que representam os cineastas nos 27 países da Europa.

A APR integra a FERA - Federação Europeia de Realizadores

A convite da FERA (Federação Europeia de Realizadores do Audiovisual), a APR esteve presente na Assembleia-Geral anual que decorreu em Budapeste entre 11 e 13 de Junho.

A candidatura da APR para se tornar membro activo da FERA foi considerada oficialmente nesta Assembleia Geral e aprovada por unanimidade. A APR passa agora a representar os realizadores portugueses seus associados numa frente comum de associações de realizadores, que representam 27 países europeus, na defesa dos seus direitos e das suas obras.

A FERA defende a arte, o saber-fazer e os direitos morais e patrimoniais do realizador como elementos essenciais da diversidade da cultura cinematográfica e audiovisual na Europa e no mundo. A FERA representa os realizadores enquanto criadores principais das obras cinematográficas e audiovisuais. O realizador que toma as decisões relativas à criação no processo de colaboração artística tem a responsabilidade final de coesão estética e integridade artística da obra.

Nesta assembleia-geral onde estiveram presentes cerca de 60 realizadores delegados pelas 30 associações europeias, debateram-se ao longo destes três dias questões que, embora de forma diversa, são comuns às cinematografias europeias: os direitos de autor, o final-cut, o progressivo desaparecimento na distribuição e na exibição dos filmes europeus nas salas de cinema, televisão, cabo e novas tecnologias. Foi ainda amplamento discutida a necessidade de elaboração de um contrato europeu de realizador que respeite o estatuto do realizador como principal autor de uma obra cinematografica.

A APR considera que este foi um passo importante para a prossecução dos seus objectivos de intervenção e vai desenvolver o diálogo, partilha de informação e delineação de projectos comuns, iniciado durante este período, com as associações suas congéneres.
